Answer · Residence permits
Can I work while waiting for my residence permit?
It depends on the document you were given when you applied. If the immigration office issued an interim certificate (Fiktionsbescheinigung), it states on it whether employment is permitted. That printed statement — not the fact that an application is pending — decides what you may do while you wait.

At a glance
- Decisive document
- Fiktionsbescheinigung (§ 81 AufenthG)
- What to check
- The box stating whether Erwerbstätigkeit is permitted
- Applying on time
- Generally keeps your lawful stay while the decision is pending
- If nothing is ticked
- Do not assume permission — ask the immigration office in writing
- Employer's view
- Payroll usually needs a copy of the certificate on file
How the interim certificate works
When a residence title cannot be issued immediately, the immigration office can issue a certificate confirming that your stay is treated as lawful while the application is being decided. The certificate itself sets out the conditions — including whether you may work and whether self-employment is included.
Two people with the same job and the same nationality can receive certificates with different boxes ticked, because the conditions follow the title being applied for and the situation you were in when you applied. Read your own document rather than another person's experience.
If you are unsure
- Photograph both sides of the certificate and read every printed condition.
- Ask the immigration office in writing whether employment is permitted; keep the reply.
- Tell your employer's payroll before the first working day, so they can document the basis.
- If the certificate is about to expire before the decision, request an extension well in advance.
Working without permission is not a small risk
Employment without the required permission can affect the pending application itself and later applications for permanent residence or citizenship. If the certificate does not clearly allow it, waiting for written clarification is the safer path.
Common mistakes
- Assuming a pending application automatically allows working.
- Relying on what a colleague's certificate allowed.
- Letting the interim certificate expire without requesting an extension.
What happens next
- The immigration office decides the application and issues the residence title.
- The conditions printed on the title replace those on the interim certificate.
- Give your employer the new document so their records match your actual status.

Related questions
- Does the interim certificate let me travel?
- Not reliably. It confirms lawful stay in Germany but is not a visa, and re-entry can be refused. Ask the immigration office before booking travel.
- What if I applied on time but got no certificate?
- Ask for one. Applying before your current title expires generally preserves your lawful stay, but you need a document that shows it.
- Does self-employment count as work here?
- It is treated separately. A certificate allowing employment does not necessarily allow freelance or self-employed activity.
