Situation · Residence permits
My residence permit expires soon
The single thing that matters is filing the extension before the current permit expires. The filing date, not the appointment date, is what generally preserves your lawful stay. If no appointment is free in time, submit the application in writing or online and ask for an interim certificate covering the gap.

At a glance
- What protects you
- Filing before expiry (§ 81 AufenthG)
- Not decisive
- When the appointment happens
- If no slot is free
- File in writing or online and keep proof
- Ask for
- A Fiktionsbescheinigung covering the gap
- Tell
- Your employer, so payroll is not interrupted
Who this applies to
- Your residence permit expires within the next few weeks or months.
- You intend to stay in Germany on the same or a related basis.
- You cannot get an appointment at the immigration office before the expiry date.
In what order
Now
File the application, whatever the appointment situation
Submit the extension request before the expiry date — online, by post or by the channel your office names. Keep the confirmation, the postal receipt or a screenshot. This date is the one that counts.
Now
Document that no appointment was available
Screenshot the booking system showing the earliest free slot. If the office later questions the timing, this is your evidence that you acted in time.
Now
Request an interim certificate
Ask explicitly for a Fiktionsbescheinigung covering the period until the decision, and ask that it state whether employment is permitted. Without that statement, your employer has nothing to rely on.
Next
Assemble the documents
Passport, current permit, registration certificate, recent payslips or enrolment certificate, health insurance confirmation, and the rental contract. Requirements differ by permit type, so check your office's list.
Next
Tell your employer or university
Give payroll or the registrar a copy of the filing confirmation and later the interim certificate. This prevents an administrative interruption that has nothing to do with your actual status.
Next
Postpone non-essential travel
An interim certificate is not a visa and does not guarantee re-entry. If travel is unavoidable, ask the immigration office in writing first.
Later
Collect the new permit and read the conditions
Conditions are reassessed at each extension, so the new card may permit something different. Read it, give a copy to your employer, and check the new expiry date.
Later
Set a reminder three months before the next expiry
The reason most people end up in this situation is that nobody reminds them. A calendar entry three months out removes the problem permanently.
Documents you need
- Current residence permit and passport
- Completed extension application for your permit type
- Registration certificate
- Recent payslips, employment contract or enrolment certificate
- Health insurance confirmation
- Proof of the filing date and of appointment unavailability
Common mistakes
- Waiting for an appointment instead of filing before the expiry date.
- Accepting an interim certificate without checking whether it permits work.
- Travelling on an interim certificate without written confirmation.
- Assuming the office will send a reminder before expiry.
What happens next
- Your stay continues on the basis of the timely application while the decision is pending.
- You collect the new permit in person once it is produced.
- The next renewal starts three months before the new expiry date.

Related questions
- What if the permit has already expired?
- File immediately anyway and explain the delay in writing. A late application is a weaker position but not the end of the process — leaving it unfiled is worse.
- Can my employer keep paying me while the decision is pending?
- That depends on what your interim certificate permits. Give them the document and let payroll assess it on that basis.
- Will the new permit have the same duration?
- Not necessarily. Duration and conditions are reassessed against your current circumstances, including income and contract type.
